Our Methodology

How Meridiane Approaches Each Matter

Every inheritance matter is individual. The legal issues present differently depending on the composition of the family, the nature of the assets involved, the religious framework applicable, and the degree of agreement or disagreement among stakeholders.

Meridiane begins each engagement by understanding the full picture — not just the immediate legal question but the circumstances behind it. From that understanding, we define a scope of work that addresses what the client actually needs, rather than a standard template applied to every file.

Assess

Understand the full situation before defining the approach

Structure

Define a clear scope with agreed timeline and fees

Execute

Carry out the work with regular client updates

Deliver

Service 01

Waqf Estate Advisory

Establishing a waqf as part of an estate plan is an act that carries both legal and religious dimensions. Meridiane provides specialist consultation on the requirements for valid waqf creation under Malaysian law, working alongside clients to understand their charitable intentions and structure those intentions in a form that the relevant State Islamic Religious Council will recognise and accept.

Our advisory covers the full process — from determining the appropriate type of waqf (property, cash, or corporate), through preparing the necessary documentation, to coordinating the submission with SIRC and following up through to confirmation of registration.

Service 02

Business Succession Planning

Family-owned businesses face particular challenges when ownership and leadership must pass to a new generation. The legal mechanics of transfer are only one part of the picture — family dynamics, business continuity, and the wishes of the departing generation all need to be integrated into a workable plan.

Meridiane facilitates the succession planning process from the initial family discussion through to the legal instruments that formalise the agreed framework. We bring structure to what can be an emotionally and legally complex process, helping families reach documented outcomes that all parties understand and support.

What This Service Includes

  • Business and personal estate situation assessment
  • Facilitated discussions with family stakeholders
  • Succession framework documentation
  • Ownership transfer mechanisms (shares, directorships)
  • Integration with individual estate planning instruments
  • Review of company constitution and shareholder agreements

Service 03

Estate Litigation Support

When families cannot reach agreement on inheritance matters, or when the validity of a will or estate distribution is disputed, court proceedings may become necessary. Meridiane provides comprehensive support to clients who find themselves in this position — whether as claimants seeking to assert their rights or as respondents defending against a claim.

Our approach to estate litigation is practical from the outset. We assess whether a negotiated settlement is achievable, and if so, we pursue it — because a settlement reached sooner is usually better for all parties, both financially and in terms of preserving family relationships. Where settlement is not achievable, we maintain full hearing preparation throughout so that clients are never disadvantaged by an assumption that the other party will agree.

What This Service Includes

  • Initial case assessment and legal position analysis
  • Evidence gathering and document compilation
  • Court filings and procedural compliance
  • Hearing attendance and court representation
  • Settlement negotiation where viable
  • Post-hearing compliance and estate administration steps
